Good and bad ways to reduce boat arrivals

Peter Mares is a long time follower of refugee issues and critic of the problems inherent in the former government’s approach to asylum seekers in boats.  He wrote a piece in The Age which emphasised a point about the Howard’s government asylum policies which does not get highlighted enough.

former treasurer Peter Costello wrote in these pages that the only way to prevent asylum seekers coming to Australia by boat is to ‘’stop the sea trade”. He is right. This may sound surprising coming from a critic of Howard-era policies towards asylum seekers, but history supports Costello’s view.  The effective deterrent was not lengthy detention on Nauru: it was the policy of turning back boats. In late 2001, in the weeks after the Tampa, the Australian Navy returned to Indonesia four boats carrying more than 500 asylum seekers. (my emphasis)

Of course, Mares rightly pointed out that an automatic consequence of a blanket approach such as this is also that “Costello should recommend that Australia withdraw from the Refugee Convention, since such actions contravene our international obligations.”

Interestingly, Greg Sheridan in The Australian pointed out the same thing. Ignoring his pointed and repeated use of the inaccurate and demonising term “illegal immigrants” to describe the asylum seekers, he rightly states that a “pivotal moment” in the Howard government’s approach was when “the Australian navy intercepted four boats of illegal immigrants (sic). The Indonesians agreed the Australian navy could force these boats back into Indonesian waters. They were forced to land in Indonesia.

He then goes on to point out the big mistake that Kevin Rudd made when he says

“the Indonesian co-operation was also based on the understanding that the Howard government would not say anything about it publicly. There was to be no boasting.”

This isn’t strictly true, as it certainly was made public that the boats were pushed back. However, it’s true there was no boasting, at least not of the sort that suggested that the Indonesians would do our bidding at the behest of a Prime Ministerial phone call from Australia.

Sheridan then goes on to run some of the standard Howard-era distortions, including some Philip Ruddock quotes and some obligatory Malcolm Fraser bashing, including the disgraceful claim that Fraser “pioneered his own Pacific solution” to “make sure no boatpeople got to Australia”.  Fraser slowed the boat flow precisely by developing a regional resettlement solution which included taking a large number of Vietnamese refugees – the sort of approach you would think someone decrying boat arrivals would applaud.

In any case, there’s not much point trying to engage far-right mythmakers and history warriors on facts or context.  None the less, it is notable that people on both sides of the debate have acknowledged or recognised that towing or pushing back the boats was the key thing that halted the flow of boats for a while, not sticking people on Nauru and certainly not counter-productive and harmful measures such as prolonged mandatory detention or Temporary Protection Visas.

Mares also puts forward a rational workable solution to the issue of asylum seekers in boats:

Successful co-operation with Indonesia requires a massive boost in UNHCR resources so that asylum cases can be processed swiftly and must ensure that there are resettlement places for those found to be refugees. The bulk of those refugees will have to come to Australia, but even if we increase our humanitarian program by 50 per cent it will still be smaller than it was in the early 1980s (the Fraser era). If resettlement places are not available, then interception in Indonesia is pointless since those assessed as refugees will still engage smugglers to attempt the crossing to Australia.

Improved co-operation with Indonesia could reduce boat numbers and orderly resettlement would help take the political sting out of the issue.

A similar approach is recommended by Jessie Taylor in her recent report into conditions in Australian funded detention centres in Indonesia.  She suggests a dual approach of installing “a controlled, robust and fair assessment and resettlement process direct from Indonesia to Australia (most logically through bolstering the capacity of the UNHCR)”, along with an increase in Australia’s refugee resettlement intake.

No solution will ever work over a prolonged period in stopping all asylum seekers arriving in boats, but there are approaches which can reduce this without breaching human rights standards or our own standards of common decency towards our fellow human beings.

    No longer an Ex-Democrat,Andrew Bartlett now a Grteen Candidate.Personally,I think, Andrew may find the Greens harder to work with as Candidate than as a previous Democrat.Nonetheless,even though I don’t vote,I wish Andrew the best,because on many issues,his sane approach from Queensland will be well representing sane Queenslanders as a Green.I hated the Democrats when they decided to emphasise the nature of the word Professional,I now think, the Greens have flogged the same horse,and has came up wanting.I doubt Queenslanders are tired of Andrew himself,he could probably be sitting in a Labor seat,maybe a Liberal seat,even the Nationals as a city based Candidate Even the Climate Skeptics would not be inclined to think he isn’t a good man.I hope therefore he wont be hurt by any result.Which is very similar to the problem of refugees and how their status has declined since the two words illegal immigrants became the substituted words of division.If the Greens’ are going to be smart they may need to reduce the impact of two words in a manner that is highly definitive in peoples’ minds and seems more relevant than illegal immigrant…

    It was 20 years ago today.
    On 20 November 1989, the international Convention on the Rights of the Child (CROC) was formally adopted.  According http://www.hrw.org/en/news/2009/11/18/us-ratify-children-s-treaty?tr=y&auid=5614841 to Human Rights Watch, the Convention became “the most widely and rapidly ratified human rights treaty in history.  Twenty years on, only two countries have failed to ratify the Convention – Somalia and the USA.
    In the USA, Presidential action to ratify an international treaty requires the approval of the Senate.  I think this is a good mechanism and one Australia should adopt, even though it would undoubtedly be frustrating from time to time.  But regardless of the distractions of health care reform and climate change legislation, this is one action the USA’s President and Senate should get moving on.

  • Road map for West Papua

    I wrote a piece recently about the new Cabinet of the Indonesian government, including their new Foreign Minister Marty Natelegawa who gained his PhD at the Australian National University.  As I’ve written a number of times, Indonesia has made very impressive progress in a range of areas in recent years.  I believe one of their biggest unaddressed challenges is West Papua, which is an issue with both internal and foreign policy components. Carmel Budiardjo, a co-director of the human rights organisation Tapol, wrote an interesting piece in the Jakarta Post about where things are at with West Papua issue.  It is a positive sign in itself that such pieces now appear in the Indonesian media.  The article draws on a report done by the Indonesian Institute of Sciences, called “Papua Road Map: Negotiating the Past, Improving the Present and Securing the Future.” The report aims to put forward “a model to achieve a comprehensive and fundamental resolution to the Papuan Conflict.”  The report was funded by the Government of Indonesia, which is another positive sign of the growing support for civil society examination of sensitive issues.

  • Senate's International students inquiry - the questioner gets questioned

    I had the slightly curious but none the less worthwhile experience a couple of weeks ago of providing evidence to a public hearing a Senate Committee inquiry, sitting on the opposite side of the table from where I’d been so many times since 1997.
    The inquiry is into issues surrounding international students.  While a lot of the media coverage has focused on violence towards some students in some southern states, there are many other systemic problems with policies affecting international students which merit consideration.  From my own experience as a witness and from reading the transcripts of other hearings, it looks like this Committee is taking its job seriously, rather than looking for political point scoring opportunities.
    The nature and breadth of the questioning from the Committee members gave me a good chance to raise a wide range issues and information I gain through the various different jobs and roles I have at the moment.  The other more immediate thing that hit me was that 4 of the 5 Senators present when I gave evidence had entered the Senate since I left less than 15 months earlier – which is a reminder how quickly the caravan moves on.

  • Updates on Qld abortion law debate

    There have been a few developments since I wrote my previous post about the uncertainty surroundnig Queensland’s abortion laws. A ‘technical’ amendment to the law was rushed through State Parliament giving the same protection for surgeons for medical abortions as currently exists for surgical abortions.  Both major parties managed to avoid having the amendment considered a conscience vote, using the rather curious argument that “the amendment did not amount to a change in the state’s abortion laws.” The relevant medical specialists clearly say this is not enough to resolve the uncertainty.  Meanwhile, the Court commital hearing for the Cairns couple charged with abortion offences under the Qld Criminal Code has got underway.   • Can we end homelessness? Interview with CEO of US Alliance to end homelessness

    A conference was held in Brisbane this week on the topic of Ending Homelessness.  I was part of a panel exploring migrants’ interaction with homeless services. One of the main speeches was by Nan Roman, who is the CEO of the National Alliance to End Homelessness in the USA. I had the chance to interview Nan Roman today on my regular weekly radio shift.  I also spent last weekend learning how to set up podcasts, so if you’re interested in the topic of homelessness, and whether it is realistic to aim to end it, hopefully you’ll be able to listen to it by going to this link.
